On August 28, 2023, the Ministry of Finance, the Ministry of Commerce, and the State Administration of Taxation jointly issued the "Announcement on the VAT Policy on the Procurement of Equipment by R&D Institutions" (hereinafter referred to as the "Announcement"). In order to encourage scientific research and technology development and promote scientific and technological progress, the announcement will continue to fully refund VAT on domestic R&D institutions and foreign-funded R&D centers for purchasing domestic equipment. The implementation period will start on September 1, 2023 and end on December 31, 2027.

Part.01

Institutions subject to the full VAT refund policy for the purchase of domestically produced equipment

01  Institutions mainly engaged in scientific research and technology development that are transformed into enterprises and enterprises approved by the Ministry of Science and Technology, the Ministry of Finance, the General Administration of Customs and the State Administration of Taxation in the process of scientific and technological system reform

02   National Engineering Research Center approved by the National Development and Reform Commission with the Ministry of Finance, the General Administration of Customs and the State Administration of Taxation

03  The enterprise technology center approved by the National Development and Reform Commission with the Ministry of Finance, the General Administration of Customs, the State Administration of Taxation and the Ministry of Science and Technology

04  The Ministry of Science and Technology in conjunction with the Ministry of Finance, State Key Laboratories (including State Key Laboratories of Enterprises) and National Engineering Technology Research Centers approved by the General Administration of Customs and the State Administration of Taxation

05  All kinds of scientific research institutes engaged in scientific research under the ministries and commissions of the State Council and directly subordinate institutions approved by the Ministry of Science and Technology, as well as all kinds of scientific research institutes engaged in scientific research under the government at the same level approved by the science and technology authorities of provinces, autonomous regions, municipalities directly under the Central Government and cities with separate plans

06  Science and technology private non-enterprise units approved by the Ministry of Science and Technology in conjunction with the Ministry of Civil Affairs or approved by the science and technology departments of provinces, autonomous regions, municipalities directly under the Central Government, cities separately included in the plan, and the Xinjiang Production and Construction Corps in conjunction with the civil affairs departments at the same level

07  The Ministry of Industry and Information Technology, in conjunction with the Ministry of Finance, the General Administration of Customs, and the State Administration of Taxation, approved the National Small and Medium-sized Enterprises Public Service Demonstration Platform (Technology)

08  Nationally recognized colleges and universities that implement junior college or above education (subject to the list published on the Ministry of Education portal)

09  Foreign-funded R&D centers that meet the following requirements;

(1) R&D expense standard: as an independent legal person, its total investment is not less than 8 million US dollars; As a non-independent legal person of the company's internal department or branch, its total R&D investment is not less than 8 million US dollars.

(2) There should be no less than 80 full-time research and experimental development personnel.

(3) The original value of the equipment purchased since its establishment shall not be less than 20 million yuan
